According to the book of genesis 2:7, it says "And the lord God formed man of the dust of the ground and breathed into his nostrils the breath of life, and he became a living soul."
Genesis 3:19 "...For you are dust and to dust you shall return." This bible Verses makes us to understand that, whether you commit an offence or not,you will die.the person passing judgment will die,the executors will die and the person that has also be convicted will die,death is the end of all human. No man is an immortal, every man will die, even the common characteristics of living things which is popularly known as "MR NIGER D" ,the "D" there simplicity death at the end of all. The question now is, do we still need to apply capital punishment which is also known as death sentence to capital offences ?
Traditionally, if we are to look at the evolution of capital punishment, we can trace its source back to the days of our forefathers, the dark ages, where laws are being made by the head of a community or by kings. This epoch can be refer to as the era that human rights does not exist.
"An eye for an eye, A tooth for a tooth." Applying this rule by our forefathers then,there are still lot of people who still commit capital offences like murder, treason, arson, armed robbery etc. The question now is have our forefathers succeeded with applying this rule ? If we narrow it down to this present age, we can see that capital punishment is not the solution for capital offences. Laws are made for humans, humans are not made for laws. If laws are made to correct the ills of the society and punishment are being given as sanctions to the breach, why then do people still commit the said offences which the sanctions has already been laid down ?
Men are creatures that are meant to relate others, the greatest thing that can be deny a man of is to deny him the company of others. In 1946, when the United nations approved the use of prison, their intention was to quarantined criminals and denying them the opportunity of relating with other people, so that they can have a sober reflection on the evil they have committed so as to give them the opportunity to repent.
For example, a suicide bomber who knows that it is not right to kill, but still goes carrying bomb on his body with the intention of killing two or more people.if he does not succed he will be taken to court and a judgment of death sentence will be pass to him. The question is does this suicide bomber care whether he's being killed or not? The truth of the matter is, he has the intention of dieing but does not want to die alone, what problem has he's death solved in the society? Instead of rehabilitating such person, the law has make a provision for such person to be executed If the law claims to maintain the sanctity and orderliness of the society, why then does it has to be the sword that is being use to cut down the people in the society which it claim to be maintaining sanctity on.
There are various ways which man can be punish well without being killed. For the fact that a man is being taken out of the society for some months is a punishment on its own, not to talk of being taken out for his life time.
There are lot of people who have been brainwashed into being serial killer, they carry out this killings not by their deed but due to what have been injected in their DNA. If a person of such is being caught, he will be executed, not considering the fact that this person has been brainwashed and does not even know the difference between which is wrong and right.
Some years back, when the European Union was advocating that death penalty should be abolish, thousands of the advocates were being sentenced to death, but the advocating did not stop. We should note that killing of criminals have not help to stop and fight criminality in the society. Nevertheless, I am not saying that a man who walk to a peaceful home with a gun to kill the occupants should go Scot free.
It is very important for us to know that, after a felon has been convicted to death, the governor of that state which the fellow had been convicted will have to sign a certificate before the execution of the felon. Information that was got from Nigerian Prison Service to Amnesty International showed that 527 people were sentenced to death in 2006, 33 were granted pardon, 32 prisoners who were on death row were exonerated, 1,979 were still on death row including five foreign nationals. During the year, a total of 105 death sentences were commuted. However, 3 people were executed in Nigeria in 2016, the first execution since 2013. We can see that this Law is not performing its function in our country
It is pertinent to note that not all man that have been pronounce guilty of an offence are guilty in the first place,maybe due to the negligence of his counsel. After series of appeal motions, if the defense counsel can not prove his case to sway the judge, his client will still be guilty. If this kind of person is being convicted and sentence to death, can we say justice has been done to his course? This act of an eye for an eye can be refer to as revenge and condemnation not justice. If the state later find out that this person did not commit this alleged offence, what will the state do to salvage their error, a dead man Cannot be brought back to life.
On this note,i therefore submmit that Capital punishment is bad, inhumane, archaic, old fashion and should be abolish from our statute books.
